These Terms & Conditions apply to bookings made for activities provided by Achieve Sports Academy Ltd (“ASA”, “we”, “us” or “our”) through our ClassForKids booking system.

Please read these Terms & Conditions carefully before making a booking. By completing a booking through ClassForKids, the parent or carer making the booking confirms that they have read, understood and agreed to these Terms & Conditions.

Nothing in these Terms & Conditions affects any statutory rights that cannot legally be excluded or restricted.

1. Scope of these Terms

These Terms & Conditions apply to all ASA activities made available through our ClassForKids booking system.

This includes, where applicable, sports clubs, after-school clubs, holiday activities, camps, specialist activities and any other ASA sessions listed through ClassForKids.

Individual activities may have additional requirements relating to age, key stage, clothing, equipment, timings or participation. These will normally be identified within the relevant ClassForKids listing or communicated separately.

2. Parent or Carer Responsibility

The person making a booking must be the child’s parent, legal guardian, carer or another person who has appropriate authority to make the booking and provide the required information and consents.

By making a booking, you confirm that:

the information supplied about the child is accurate and complete

you have authority to make decisions relating to the booking

you will keep the child’s information up to date

you will tell ASA about any important changes affecting the child’s health, safety or participation

you accept these Terms & Conditions.

3. Booking a Place

Places are subject to availability and maximum capacity.

A child’s place is not secured until the booking has been successfully completed through ClassForKids and any payment required at the time of booking has been successfully received or confirmed.

Submitting information, beginning checkout or expressing an interest in an activity does not reserve a place.

ASA may establish minimum and maximum participant numbers for individual activities.

4. Age and Key Stage Requirements

Activities may be designated for KS1, KS2 or both, depending on the activity.

Parents and carers are responsible for checking that their child meets the eligibility requirements shown on the ClassForKids listing before booking.

If a child has accidentally been booked onto an inappropriate activity, ASA will, where reasonably possible, transfer the child to a suitable alternative.

Where an appropriate transfer is unavailable, ASA may issue ASA credit for the value of the affected booking.

5. Prices and Payment

The price displayed when a booking is made is the price applicable to that booking, subject to any obvious pricing error.

ASA may change prices for future activities, future terms or new bookings.

A price change will not normally affect an existing confirmed and fully paid booking.

All payments must be made using the payment arrangements provided through ClassForKids or another payment method expressly agreed by ASA.

6. Failed, Reversed or Outstanding Payments

If a payment fails, is reversed, disputed, charged back or otherwise remains unpaid, ASA may suspend or cancel the associated booking until the outstanding amount has been resolved.

ASA reserves the right to recover legitimately outstanding sums.

7. Individual Session Cancellations by Parents or Carers

ASA operates a credit-based cancellation policy for parent/carer cancellations.

If you need to cancel an individual booked session, you must email:

The email must be sent at least 24 hours before the scheduled start of the session and should explain the reason for cancellation.

Where the required notice is provided, ASA will normally provide ASA credit for the eligible value of the cancelled session rather than a cash refund.

This applies to circumstances including illness, injury, holidays, changes of plans or other circumstances preventing attendance.

8. Cancellations With Less Than 24 Hours’ Notice

Cancellations made less than 24 hours before the scheduled session do not automatically qualify for a refund, credit or voucher.

However, ASA recognises that exceptional circumstances can arise.

ASA may, at its discretion, issue credit where it considers the circumstances justify doing so.

Any discretionary decision does not create an entitlement to the same outcome for future bookings or other families.

9. Non-Attendance

If a child does not attend a booked activity and ASA has not received the required notice, the session will normally be treated as an absence.

No automatic refund or credit will be provided.

ASA may consider exceptional circumstances at its discretion.

For school-based activities, if a child does not arrive at the ASA activity as expected, they may be recorded as absent.

Parents/carers remain responsible for ensuring that the school is aware of the child’s ASA club arrangements where the school’s procedures require this.

10. Cancelling the Remainder of a Full-Term Booking

A parent/carer may request cancellation of the remaining sessions within a full-term booking.

At least 48 hours’ written notice must be provided to:

Where the required notice is given, ASA will normally issue ASA credit equivalent to the value of the eligible remaining unused sessions.

Cash refunds are not normally provided for parent-initiated cancellation of the remainder of a term.

Requests made with less than 48 hours’ notice may be considered at ASA’s discretion.

11. ASA Credit

ASA credit may be issued in accordance with these Terms & Conditions.

Unless ASA expressly confirms otherwise:

credit may be used against any eligible ASA activity available through ASA’s ClassForKids booking system

credit is restricted to the family to whom it was issued

credit cannot be transferred to another family

credit may be used for eligible children within the same family

credit cannot be sold, exchanged or redeemed for cash

unused balances may continue to be used until the applicable expiry date.

If, for example, £30 of credit is used against a £20 booking, the remaining £10 will remain available until the original credit expiry date.

12. Credit Expiry

ASA credit will normally be valid for the remainder of the school term in which it is issued.

If credit is issued during the final week of the current school term, it will instead remain valid for the following school term.

Unused credit expires at the end of its applicable validity period unless ASA expressly agrees otherwise.

Parents/carers are responsible for using available credit before it expires.

13. Bookings Made Using Credit

ASA credit has no cash redemption value.

If a booking made using ASA credit is subsequently cancelled and qualifies for a credit under these Terms & Conditions, the eligible value will be returned as ASA credit.

It will not become eligible for a cash refund simply because it has subsequently been used to make another booking.

Where a booking has been paid partly using ASA credit and partly through another payment method, ASA may return the affected booking value as ASA credit where these Terms provide for credit.

14. Cancellation by ASA

Occasionally ASA may need to cancel an activity, for example because of coach unavailability, insufficient participant numbers, safety concerns or another operational issue.

Where ASA cancels an activity, ASA may first offer:

a replacement session

a rescheduled session

an appropriate alternative, or

ASA credit for the affected value.

Where an appropriate replacement, rescheduled session, alternative or credit arrangement cannot reasonably be provided, ASA will provide an appropriate refund for the affected ASA-cancelled session where required.

If the original booking was made using ASA credit, the relevant value will be returned as ASA credit rather than cash.

15. Cancellation or Closure by a School or Venue

ASA sometimes delivers activities using facilities belonging to schools or other venues.

There may be circumstances where the school or venue prevents an activity from taking place for reasons outside ASA’s control. Examples may include emergency closure, loss of access to the facility, utility failure, a school event or another unexpected closure.

Where the school, venue or location cancels or prevents the activity from taking place, ASA will normally provide ASA credit for the affected session rather than a cash refund.

That credit will normally remain valid for the remainder of the current term.

Where the cancellation occurs during the final week of term, the credit will remain valid for the following term.

This provision does not affect any statutory rights that apply in the particular circumstances.

16. Changes to Activities

The activities described or advertised as part of a club, camp or session may occasionally need to change.

ASA may reasonably alter, substitute or remove an individual activity because of safety considerations, participant numbers, equipment availability or other operational circumstances.

For example, one planned game or sporting activity may be substituted for another.

A reasonable change to the content of a session does not constitute cancellation of the overall booked service and does not automatically create an entitlement to a refund or credit.

17. Venue Arrangements

ASA will not ordinarily move a booked activity to a completely different external venue.

Operational changes within the same school or venue, such as using a different sports hall, classroom or suitable activity area, may be made where reasonably necessary.

18. Minimum Participant Numbers

Some activities require a minimum number of participants to operate appropriately.

ASA reserves the right to cancel an activity where insufficient bookings have been received.

Such a cancellation will be treated as an ASA cancellation and dealt with under the ASA cancellation provisions above.

19. Child Information and Onboarding

Parents/carers must complete the required child information and onboarding information accurately.

This may include information concerning:

emergency contacts

allergies

medical conditions

medication

additional needs

relevant SEND information

communication or behavioural needs

collection arrangements

photography/media choices

other information reasonably required to provide the activity safely.

Parents/carers are responsible for keeping this information accurate and up to date.

An important change that could affect the child’s immediate safety or participation should also be communicated directly to ASA rather than relying solely on an online account update.

20. SEND, Disabilities and Additional Needs

ASA aims to provide an inclusive environment and will consider the individual needs of children attending its activities.

Parents/carers should provide ASA with relevant information about a child’s disability, SEND, medical condition or other support needs so that appropriate arrangements can be considered.

Having an additional need does not in itself prevent a child from participating.

However, ASA must be able to provide the activity safely for the individual child, other children and staff.

ASA may contact the parent/carer to discuss reasonable arrangements before participation.

Where ASA reasonably considers that additional arrangements are required before participation can safely take place, attendance may need to be delayed while those arrangements are discussed.

Nothing in these Terms & Conditions is intended to restrict any rights or obligations arising under applicable equality legislation.

21. ASA’s Right to Refuse or Cancel a Booking

ASA may refuse, suspend or cancel a booking where there is a genuine safeguarding, safety, eligibility or significant operational reason for doing so.

This may include circumstances where:

a child does not meet the advertised age or eligibility requirements

essential medical or safety information has not been provided

ASA reasonably requires further information before participation can safely take place

participation would create an unacceptable safety or safeguarding risk

payment remains outstanding

serious behavioural concerns exist.

ASA will act reasonably and will consider individual circumstances where appropriate.

Nothing in this provision permits unlawful discrimination.

22. Medical Conditions and Medication

Relevant medical conditions, allergies and medication requirements must be disclosed through the child’s onboarding information.

Where a child may require medication during an activity, the parent/carer must also notify ASA or the attending coach in advance of each relevant class or session.

Required medication must be supplied in an appropriate form and, where applicable, clearly identified for the child with suitable instructions.

This includes emergency medication such as inhalers and adrenaline auto-injectors.

Parents/carers remain responsible for ensuring medication supplied for their child is appropriate, in date and available when required.

23. First Aid and Emergencies

ASA coaches are first-aid trained.

By booking an ASA activity, parents/carers acknowledge that ASA staff may provide appropriate first aid when reasonably necessary.

If ASA reasonably considers that emergency medical assistance is required, ASA may contact the emergency services without waiting for prior parental permission.

ASA will make reasonable efforts to contact the child’s parent/carer or emergency contact as soon as reasonably practicable.

The child’s immediate safety and welfare will take priority during an emergency.

24. Illness

Parents/carers must not knowingly send a child to an ASA activity where the child is clearly unwell, infectious or otherwise not fit to participate safely.

If a child becomes unwell during an activity, ASA may determine that they should no longer participate.

The parent/carer or emergency contact may be required to collect the child as soon as reasonably possible.

Any cancellation or missed-session entitlement will be determined under the cancellation provisions in these Terms & Conditions.

25. Behaviour

Children attending ASA activities are expected to behave in a manner that allows the activity to operate safely and positively.

ASA will not tolerate serious or persistent behaviour including:

bullying

violence or physical aggression

abusive, threatening or discriminatory behaviour

deliberately unsafe behaviour

significant or persistent disruption

deliberate damage to property

repeated refusal to follow reasonable safety instructions.

ASA will normally seek to manage behavioural concerns proportionately and appropriately.

However, serious incidents may require immediate action.

26. Suspension or Removal for Behaviour

ASA reserves the right to suspend or permanently remove a child from an activity where their behaviour presents a significant safety, safeguarding or welfare concern, or where serious or persistent behaviour makes continued participation unreasonable.

Where a place is terminated because of the child’s serious or persistent behaviour, there is no automatic entitlement to a refund or credit for remaining sessions.

ASA may consider individual circumstances at its discretion.

27. Appropriate Clothing, Footwear and Equipment

Parents/carers are responsible for ensuring that their child arrives appropriately dressed and equipped for the booked activity.

This includes suitable clothing, appropriate footwear and any equipment or items specifically requested for the session.

Children should bring a suitable water bottle where appropriate.

If ASA considers that a child’s clothing, footwear or equipment makes participation unsafe, ASA may restrict or prevent participation in some or all of the activity.

This does not automatically create an entitlement to a refund or credit.

28. Food, Snacks and Drinks

Where the length or nature of an activity requires children to bring food, parents/carers are responsible for providing sufficient appropriate food, snacks and drinks for their child.

ASA activities operate on a nut-free basis. Parents/carers must therefore not knowingly provide food containing nuts for consumption during ASA activities.

Parents/carers must ensure ASA has accurate information concerning their child’s allergies or dietary requirements where relevant to their safety.

29. Personal Belongings

Children should avoid bringing unnecessary valuables to ASA activities.

ASA cannot accept responsibility for loss of or damage to personal possessions except where the loss or damage results from ASA’s negligence or where liability cannot legally be excluded.

Parents/carers should ensure personal belongings are clearly identifiable where appropriate.

30. Arrival and Attendance

Parents/carers are responsible for ensuring their child arrives at the correct activity at the appropriate time, except where arrangements with the school provide for children to be transferred directly to an after-school activity.

For school-based clubs, parents/carers must also ensure the school is aware of the child’s attendance where required by the school’s own procedures.

Late arrival may reduce the amount of activity time available and will not normally result in a refund or credit.

31. Collection of Children

Children must be collected promptly at the advertised finishing time.

ASA will not ordinarily allow a child to leave an activity independently.

Independent departure will only be permitted where this has been specifically discussed and agreed in advance between ASA and the child’s parent or guardian.

Parents/carers must inform ASA in advance where someone different will collect their child.

ASA may refuse to release a child to a person whom ASA cannot reasonably verify as authorised to collect them.

The child’s safety will take priority where there is uncertainty.

32. Late Collection

Parents/carers are responsible for ensuring appropriate collection arrangements are in place and for collecting children promptly.

ASA does not currently operate an automatic contractual late-collection fee.

However, repeated or excessive late collection may result in ASA contacting the parent/carer to review arrangements.

Where the problem continues, ASA may reconsider whether it can safely continue to provide the child’s place.

33. Uncollected Children

If an authorised person fails to collect a child and ASA cannot contact the parent/carer, ASA will make reasonable attempts to contact the emergency contacts provided.

Where a child remains uncollected and appropriate contacts cannot be reached, ASA may follow appropriate safeguarding procedures.

Where necessary to protect the child’s welfare, this may include seeking assistance from the school, relevant safeguarding services or the police.

ASA staff will not simply leave an uncollected child unattended.

34. Safeguarding

The safety and welfare of children attending ASA activities is a priority.

ASA may take appropriate action where a coach or other responsible person has a safeguarding concern relating to a child.

This may include recording concerns and sharing information with appropriate safeguarding professionals, statutory authorities, the school or emergency services where necessary or legally required to protect a child.

Parental consent is not required before information is shared where doing so is reasonably necessary to protect a child or comply with a legal safeguarding obligation.

35. Photography and Video by ASA

Photography and video preferences are managed separately through ASA’s onboarding arrangements.

Parents/carers will be given the opportunity to provide the relevant information or choices concerning use of their child’s image.

Acceptance of these Terms & Conditions does not itself constitute consent for ASA to use a child’s photograph or video for marketing purposes.

ASA will have regard to the relevant permissions and information recorded for the child.

36. Photography and Video by Parents or Carers

Parents/carers must respect the privacy and safeguarding of other children attending ASA activities.

Parents/carers must not photograph or film other children during ASA activities without appropriate permission.

Parents/carers must not publish identifiable photographs or video of another child through social media or other public channels without appropriate permission.

ASA may prohibit photography or filming at particular activities where this is considered appropriate for safeguarding, privacy or venue reasons.

37. Data Protection

ASA processes information about parents/carers and children in order to administer bookings, communicate with families, deliver activities safely, manage payments and meet relevant safeguarding, operational and legal obligations.

Parents/carers must provide accurate information and keep it up to date.

ASA will handle personal information in accordance with applicable UK data protection legislation.

Where ASA relies on a separate choice or consent for a particular use of personal information, such as certain photography or marketing activities, this will be managed separately from acceptance of these booking Terms & Conditions.

38. Communications

Parents/carers are responsible for providing accurate contact information and monitoring communications relating to their booking.

ASA may communicate important booking information through ClassForKids, email or other contact details supplied by the parent/carer.

Parents/carers should ensure ASA communications are not inadvertently blocked or directed to spam/junk folders.

39. Complaints and Concerns

ASA aims to deal with concerns fairly and appropriately.

A complaint or formal concern should be submitted to:

Please provide sufficient information for ASA to understand and investigate the matter.

ASA aims to acknowledge a complaint within three working days.

Acknowledgement does not mean that the investigation will necessarily be completed within three working days.

ASA will seek to investigate and respond within a reasonable period having regard to the nature and complexity of the matter.

Safeguarding concerns may need to be dealt with under different procedures and may involve appropriate external organisations.

40. Liability

ASA will exercise reasonable care and skill in providing its activities.

ASA is not responsible for loss or damage that:

was not reasonably foreseeable

results from inaccurate or incomplete information provided by a parent/carer

is caused by the actions of the participant or parent/carer

results from circumstances outside ASA’s reasonable control, except where the law provides otherwise.

Nothing in these Terms & Conditions excludes or limits ASA’s liability where it would be unlawful to do so.

In particular, nothing excludes or limits liability for death or personal injury caused by ASA’s negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

41. Circumstances Outside ASA’s Reasonable Control

ASA may sometimes be unable to provide an activity because of circumstances outside its reasonable control.

Examples may include a venue unexpectedly becoming unavailable, emergency school closure, serious utility failure, restrictions imposed by an appropriate authority or another event that ASA could not reasonably prevent.

ASA will communicate material disruption to affected families as soon as reasonably practicable.

Any applicable credit, alternative arrangement or other remedy will be determined in accordance with these Terms & Conditions and applicable consumer law.

42. Changes to Prices

ASA may revise the price of future activities or future terms.

Unless otherwise clearly stated, a price change will apply to new bookings and future renewals rather than retrospectively increasing the price of an existing confirmed and fully paid booking.

43. Changes to These Terms & Conditions

ASA may update these Terms & Conditions from time to time.

The version accepted when a booking is made will normally apply to that confirmed booking.

ASA may make changes affecting existing bookings where reasonably necessary because of changes in law, safeguarding requirements, health and safety requirements or another compelling reason.

Where a material change affects an existing booking, ASA will take reasonable steps to communicate it to affected parents/carers.

44. Statutory Consumer Rights

These Terms & Conditions set out ASA’s contractual cancellation, credit and refund arrangements.

They do not remove or restrict any statutory consumer rights that cannot legally be excluded.

Where applicable law gives a parent/carer a remedy that differs from these contractual arrangements, the applicable statutory right will take precedence.

45. Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed only to the extent necessary.

The remaining provisions will continue to apply.

46. No Waiver

If ASA chooses not to enforce a particular provision on one occasion, this does not prevent ASA from enforcing that provision on another occasion.

Similarly, ASA exercising discretion to provide a credit, transfer or other goodwill arrangement in one case does not create an automatic entitlement for future cases.

47. Governing Law

These Terms & Conditions and bookings made under them are governed by the laws of England and Wales.

Nothing in this section removes any rights a consumer may have concerning where legal proceedings can be brought under applicable consumer law.

49. Acceptance

By completing a booking through ASA’s ClassForKids booking system, the parent/carer confirms that they have had the opportunity to read these Terms & Conditions and agrees to be bound by them.

Parents/carers should retain a copy for their records.
